Terms and Conditions
Last updated: 7 October 2026
These Terms and Conditions apply to purchases from Bel Air Furniture through our website at belair-furniture.com and, where applicable, to other orders placed directly with us.
Please read these Terms and Conditions before placing an order. By placing an order, you agree to these Terms and Conditions. Nothing in these Terms and Conditions limits any mandatory rights you may have as a consumer under applicable law.
1. About Bel Air Furniture
Bel Air Furniture is operated by:
- Legal company name: Bel Air Furniture B.V.
- Trading name: Bel Air Furniture
- Registered address: Admiralengracht 35, 1057EM Amsterdam
- Country: The Netherlands
-
Chamber of Commerce (KVK) number: 33246806
- Email: info@belair-furniture.com
- Telephone: +31 (0)20 4965038
- Website: belair-furniture.com
In these Terms and Conditions, "Bel Air Furniture", "Bel Air", "we", "us" and "our" refer to the company identified above.
A "Consumer" is a natural person purchasing primarily for purposes outside their trade, business, craft or profession.
A "Business Customer" is a person or organisation purchasing wholly or mainly for business or professional purposes.
2. Application of these Terms
These Terms and Conditions apply to offers, orders and agreements between Bel Air Furniture and our customers unless otherwise agreed in writing.
Where mandatory consumer law provides a Consumer with greater protection than these Terms and Conditions, the mandatory law takes priority.
Additional or different conditions proposed by a Business Customer do not apply unless expressly accepted by Bel Air Furniture in writing.
3. Products and Product Information
We aim to describe and display our products as accurately as reasonably possible, including dimensions, materials, colours, specifications and photographs.
Colours shown on screens may vary slightly from the actual product because of differences in screens, lighting, materials and manufacturing batches.
Small variations in colour, texture, finish, stitching, dimensions or other characteristics which are normal for the materials or manufacturing process are not necessarily defects.
Product dimensions are approximate unless expressly stated otherwise. Customers should check that the dimensions of a product are suitable for the intended location before ordering.
For large furniture, the customer is responsible for checking that the product can reasonably pass through entrances, doors, hallways, staircases, lifts and other access points at the delivery address.
Nothing in this section affects a Consumer's legal rights where a product does not conform to the agreement or to what the Consumer could reasonably expect.
4. Prices
Prices displayed to Consumers include VAT where applicable, unless clearly stated otherwise.
Delivery charges and any other additional charges will be shown before the customer completes the order.
For Business Customers, prices may be quoted excluding VAT where this is made clear.
We may change prices at any time, but a price change will not affect an order that we have already accepted, except where an obvious pricing error has occurred.
If an obvious pricing or technical error occurs, we may contact the customer before dispatch to correct the error. The customer may then choose to proceed at the correct price or cancel the order for a full refund.
5. Placing an Order
Products displayed on our website are an invitation to place an order and do not by themselves constitute acceptance of an order.
Before placing an online order, customers have the opportunity to review and correct their order.
By clicking the final order button, the customer confirms that the order creates an obligation to pay.
After an order is placed, we will send an electronic confirmation. The purchase agreement is concluded when we accept the order, normally by sending an order confirmation or confirming that the order will be processed.
We reserve the right to refuse an order for legitimate reasons, including suspected fraud, payment problems, product unavailability, errors in product information or restrictions relating to the delivery destination.
If we cannot accept an order after payment has been made, we will refund the amount paid without undue delay.
6. Payment
Available payment methods are displayed during checkout or stated on our quotation or invoice.
Unless otherwise agreed, payment must be made in accordance with the payment terms shown during checkout, on the quotation or on the invoice.
Customers are responsible for providing accurate payment and billing information.
For Business Customers purchasing on invoice, any agreed payment term will be stated on the invoice or quotation.
7. Ownership
Where permitted by law, ownership of products remains with Bel Air Furniture until the purchase price and any amounts directly connected with the relevant purchase have been paid in full.
This does not affect the transfer of risk to Consumers as described below.
8. Delivery
Available delivery destinations, methods and estimated delivery times are stated on our website, during checkout, in the order confirmation or in an individual quotation.
We will deliver within the delivery period agreed with the customer. Where no specific delivery period has been agreed with a Consumer, delivery will take place without undue delay and, in principle, no later than 30 days after conclusion of the agreement unless otherwise agreed.
Delivery times provided as estimates are not guaranteed dates unless we expressly agree that a particular date is essential.
If delivery is delayed, we will inform the customer where reasonably possible.
If we fail to deliver a Consumer's order within the agreed period, the Consumer may give us an appropriate additional period to deliver, except where applicable law allows immediate cancellation. If delivery still does not take place within that additional period, the Consumer may terminate the agreement and receive a refund in accordance with applicable law.
9. Large Furniture and Delivery Access
Many Bel Air Furniture products are large and may require special handling.
The customer is responsible for providing accurate delivery information and for checking access to the delivery location.
Unless a specific installation, assembly or room-of-choice service has been purchased, delivery does not automatically include assembly, installation, removal of existing furniture or movement of products beyond the delivery service described when ordering.
If delivery cannot reasonably be completed because access is inadequate, nobody is available to receive the order where attendance was agreed, or the delivery information supplied by the customer is incorrect, reasonable additional delivery, storage or redelivery costs may be charged where legally permitted.
This provision does not apply where the failed delivery is caused by Bel Air Furniture or our appointed carrier.
10. Risk of Loss or Damage
For Consumers, Bel Air Furniture bears the risk of accidental loss of or damage to the products until the Consumer, or a third party designated by the Consumer other than the carrier, has physically received them.
If a Consumer independently appoints a carrier that was not offered by Bel Air Furniture, risk may transfer when the goods are handed to that carrier, to the extent permitted by law.
For Business Customers, different delivery or risk arrangements may be agreed in writing, including through an accepted quotation or applicable Incoterm.
11. Checking Deliveries and Transport Damage
We recommend checking deliveries for visible transport damage as soon as reasonably possible.
If packaging or products arrive visibly damaged, please photograph the packaging and product and contact us promptly. This helps us investigate the matter with the carrier.
A Consumer does not lose mandatory statutory rights merely because transport damage was not reported immediately upon delivery.
12. Consumer Right of Withdrawal
This section applies only to Consumers purchasing at a distance, including through our website.
Subject to the exceptions below, a Consumer has the right to withdraw from an online purchase without giving a reason within 14 days.
For the purchase of goods, the withdrawal period normally expires 14 days after the day on which the Consumer, or a third party designated by the Consumer other than the carrier, receives the goods.
If one order contains multiple goods delivered separately, the withdrawal period generally begins when the last relevant item is received, where required by applicable law.
To exercise the right of withdrawal, the Consumer must clearly inform us of the decision to withdraw before the withdrawal period expires.
The Consumer may do this using:
- the online withdrawal function available on our website;
- the model withdrawal form included at the end of these Terms and Conditions;
- email to [CUSTOMER SERVICE EMAIL]; or
- another clear statement informing us of the decision to withdraw.
The use of the model withdrawal form is optional.
13. Online Withdrawal Function
Where required by law, Bel Air Furniture provides an easily accessible online function through which Consumers may notify us that they wish to withdraw from an eligible online purchase.
After a Consumer submits a withdrawal notification through this function, we will provide acknowledgement of receipt on a durable medium where required by law.
14. Returning Products After Withdrawal
After notifying us of withdrawal, the Consumer must return the products without undue delay and no later than 14 days after notifying us, unless we have agreed to collect the products.
Return instructions and the applicable return address will be provided by Bel Air Furniture.
Consumers are responsible for the direct cost of returning products where they were informed of this obligation before purchase.
Many of our furniture products cannot normally be returned by standard postal services. Where this applies, an estimate of the return transportation cost will be provided before the purchase as required by law.
If Bel Air Furniture has agreed to bear the return costs, or if applicable law requires us to bear them, the Consumer will not be charged those costs.
Customers should not return large furniture without first contacting us so that appropriate transport arrangements can be made.
15. Condition of Returned Products
During the withdrawal period, Consumers may handle a product only to the extent necessary to establish its nature, characteristics and functioning, broadly as they would reasonably be able to do in a physical shop.
A Consumer may be responsible for diminished value resulting from handling beyond what is necessary for this purpose.
Opening packaging alone does not automatically remove the right of withdrawal.
Where reasonably possible, products should be returned with their original packaging and accessories because appropriate packaging helps prevent damage in transit. The absence of original packaging does not by itself remove a Consumer's statutory right of withdrawal.
16. Refunds Following Withdrawal
If a Consumer validly withdraws from the entire agreement, we will reimburse payments received in relation to that agreement, including the cost of our least expensive standard delivery method, as required by law.
If the Consumer chose a more expensive delivery method than our least expensive standard delivery method, we are not required to reimburse the additional delivery cost.
Refunds will be made without undue delay and no later than 14 days after we are informed of the withdrawal.
For sales of goods, we may withhold reimbursement until we have received the goods back or the Consumer has provided evidence of having returned them, whichever occurs first, unless we have agreed to collect the goods.
Refunds will normally be made using the same payment method used for the original transaction unless expressly agreed otherwise and provided this does not result in additional costs to the Consumer.
17. Products Excluded from the Right of Withdrawal
The statutory right of withdrawal does not apply in circumstances excluded by law.
In particular, the right of withdrawal may not apply to goods that are made to the Consumer's specifications or are clearly personalised.
This may include furniture manufactured or modified specifically for the customer using customer-selected specifications which make the product clearly personalised, such as special dimensions, non-standard materials, custom upholstery, individually selected colour combinations or other bespoke modifications.
The fact that a product is manufactured after an order is placed does not by itself necessarily make it exempt from the right of withdrawal.
If a product is excluded from the right of withdrawal because it is made to the customer's specifications or clearly personalised, we will make this clear to the Consumer before the order is placed.
18. Made-to-Order Products
Some Bel Air Furniture products are available on a made-to-order basis.
The applicable production time, specifications and other relevant conditions will be provided before the order is confirmed.
A made-to-order product that is made to standard specifications may still be covered by the Consumer's statutory right of withdrawal.
A made-to-order product that is genuinely made to the Consumer's specifications or clearly personalised may be excluded from the statutory right of withdrawal as explained above.
Nothing in this section affects legal rights concerning defective, damaged, incorrectly supplied or non-conforming products.
19. Statutory Guarantee and Conformity
Consumers are entitled to receive products that conform to the purchase agreement and possess the quality and characteristics they may reasonably expect, taking into account matters such as the product description, price, intended use and statements made by Bel Air Furniture.
Under Dutch law, statutory guarantee rights are not limited to a fixed two-year period. The duration depends on how long a Consumer may reasonably expect the product to function properly in the circumstances.
If a product is defective or does not conform to the agreement, the Consumer may be entitled to an appropriate legal remedy, which may include repair or replacement free of charge and, where the legal requirements are met, a price reduction or termination of the agreement and refund.
Statutory remedies will be provided within a reasonable time, without significant inconvenience to the Consumer and without costs that the Consumer should not legally have to bear.
Damage caused by misuse, abnormal use, accidents, improper maintenance, unauthorised modification or normal wear and tear is not necessarily a lack of conformity.
Nothing in these Terms and Conditions restricts or replaces mandatory statutory guarantee rights.
20. Bel Air Furniture Commercial Warranty
Where stated in connection with a product, Bel Air Furniture provides a 2-year commercial warranty in addition to the Consumer's statutory rights.
The commercial warranty does not replace, restrict or shorten any rights the Consumer has under applicable consumer law. Statutory rights may continue after the commercial warranty period has expired.
The applicable commercial warranty conditions, including its duration, geographical scope, coverage, exclusions and the procedure for making a warranty claim, will be provided to the Consumer on a durable medium as required by law.
Unless otherwise stated in the applicable warranty conditions, the commercial warranty covers manufacturing and material defects occurring during normal intended use and does not cover normal wear and tear, accidental damage, misuse, incorrect maintenance or unauthorised modifications.
21. Complaints
If you believe there is a problem with your order or product, please contact us at:
[CUSTOMER SERVICE EMAIL]
Please provide your order number and, where relevant, a description and photographs of the issue so that we can investigate efficiently.
We aim to acknowledge and deal with complaints within a reasonable period.
Consumers retain all statutory rights regardless of our internal complaint procedure.
22. Business Customers
The statutory Consumer right of withdrawal does not apply to purchases made by Business Customers.
Business Customers may cancel or return products only where expressly agreed by Bel Air Furniture in writing.
Custom, bespoke and made-to-order Business Customer orders cannot be cancelled after production has commenced unless we expressly agree otherwise.
A Business Customer must inspect delivered products within a reasonable time and notify us promptly of visible shortages, incorrect products or damage.
This requirement does not affect liability that cannot lawfully be excluded.
Specific quotations, project agreements, dealer agreements or reseller agreements may contain additional terms. Where expressly agreed, those specific terms take priority over these general Terms and Conditions in the event of a conflict.
23. Intellectual Property
Unless otherwise stated, the content of the Bel Air Furniture website, including photographs, product designs, text, graphics, logos and other materials, is owned by or licensed to Bel Air Furniture and is protected by applicable intellectual property laws.
Website content may be viewed and used for normal personal or business purchasing purposes.
Content may not be reproduced, commercially exploited, distributed or used in a misleading manner without our permission unless such use is permitted by law.
Authorised Bel Air Furniture dealers and resellers may use materials supplied to them in accordance with any applicable dealer or reseller agreement or permission granted by Bel Air Furniture.
24. Website Information and Availability
We aim to keep our website accurate and available but cannot guarantee uninterrupted or error-free operation at all times.
We may update website content, product ranges, specifications and availability.
Nothing in this section excludes liability or legal obligations that cannot lawfully be excluded.
25. Liability to Consumers
Nothing in these Terms and Conditions excludes or limits liability where doing so would be prohibited by applicable law.
In particular, these Terms and Conditions do not limit mandatory rights relating to defective or unsafe products, statutory guarantee rights, personal injury caused by legally attributable acts, fraud or other liability which cannot legally be excluded or restricted.
Bel Air Furniture is not responsible for losses caused solely by circumstances attributable to the customer, including use of a product contrary to its intended use or supplied instructions, except where applicable law provides otherwise.
26. Liability to Business Customers
To the maximum extent permitted by law, Bel Air Furniture will not be liable to Business Customers for indirect or consequential losses, including loss of profit, revenue, contracts or business opportunities, unless expressly agreed otherwise.
To the maximum extent permitted by law, our aggregate contractual liability to a Business Customer in relation to an order is limited to the amount paid or payable for the products giving rise to the claim.
These limitations do not apply where liability cannot lawfully be limited or excluded, including where applicable in cases of intent, deliberate recklessness, fraud, death or personal injury, or mandatory product liability.
27. Force Majeure
We are not responsible for a failure or delay caused by circumstances outside our reasonable control, such as natural disasters, war, governmental restrictions, major transport interruptions, strikes outside our organisation, serious supply-chain disruption, fire, flooding or similar events.
Where such an event affects an order, we will inform the customer where reasonably possible and take reasonable steps to reduce the delay.
This clause does not remove a Consumer's mandatory rights, including rights relating to delivery or termination where those rights apply by law.
28. Privacy and Cookies
Personal data is processed in accordance with our Privacy Policy.
Information about our use of cookies and similar technologies is provided in our Cookie Policy and through our cookie consent settings.
Where consent is legally required for non-essential cookies or similar technologies, these technologies will not be used on the basis of consent until the required consent has been obtained.
29. Changes to these Terms and Conditions
We may update these Terms and Conditions from time to time, for example because of changes to our business, products or applicable law.
The Terms and Conditions applicable to an order are normally the version made available to the customer when that order is placed.
Changes made after an order is concluded do not retrospectively alter that agreement unless legally permitted and agreed where required.
30. Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent legally possible.
31. Applicable Law
These Terms and Conditions and agreements with Bel Air Furniture are governed by Dutch law.
For Consumers, this choice of Dutch law does not deprive the Consumer of mandatory protections available under the law that would otherwise apply to them, including mandatory consumer protections in the Consumer's country of habitual residence where applicable.
32. Disputes
We encourage customers to contact Bel Air Furniture first so that we can attempt to resolve any dispute directly.
Disputes may be submitted to the competent court in accordance with applicable law.
Nothing in these Terms and Conditions restricts a Consumer's statutory right to bring proceedings before a court that has jurisdiction under applicable consumer law.
